Welcome to BeliPharm! These Terms of Service ("Terms") create a legal agreement between you ("User," "you") and ("Company," "we," "us") that governs your use of our mobile application, website, and all related services (collectively, the "Platform").

1. Acceptance of Terms

By creating an account, accessing, or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

2. CRITICAL: Medical & Health Disclaimers

DO NOT USE THIS PLATFORM FOR MEDICAL EMERGENCIES. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, PLEASE CALL [e.g., 999/112] IMMEDIATELY.

  • NO MEDICAL ADVICE: All content available on the Platform is for informational and educational purposes only. It is not intended as, and shall not be understood or construed as, professional medical advice, diagnosis, or treatment.
  • NO DOCTOR-PATIENT RELATIONSHIP: Your use of the Platform, including any communication with a healthcare provider via the Platform, does not create a doctor-patient or pharmacist-patient relationship.
  • CONSULT YOUR DOCTOR: Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this Platform.
  • USE AT YOUR OWN RISK: You acknowledge and agree that you are using the Platform at your own risk. The Company will not be liable to you or anyone else for any decision made or action taken in reliance on the information given by the Platform.

3. E-Pharmacy & Prescription Policy

The Platform facilitates the fulfillment of prescriptions from licensed, independent pharmacies ("Partner Pharmacies"). You and all Partner Pharmacies agree to adhere to the following, in compliance with the Pharmacy and Poisons Board (PPB) Guidelines for Internet Pharmacy Services:

  • Valid E-Prescription Required: We will not process or dispense any Prescription-Only Medicine (POM) without a valid, original e-prescription from a healthcare professional authorized to prescribe in Kenya.
  • Pharmacist Verification: By submitting a prescription, you agree that it is subject to the scrutiny and approval of a qualified pharmacist at one of our Partner Pharmacies. The pharmacist retains the full, professional discretion to refuse to dispense any prescription.
  • No Advertising of POMs: The Platform does not advertise or promote any Prescription-Only Medicines to the public.
  • PPB Health Safety Code: The Platform and its Partner Pharmacies are registered with the PPB, and the relevant health safety code(s) will be displayed as required by law.
  • Patient Counselling: You will have access to the dispensing pharmacist for consultation regarding your medication, as required by law.

4. Our Role as a Platform

BeliPharm is a technology platform that connects Patients with independent, third-party Providers (e.g., Pharmacies, Doctors). We are not a healthcare provider, pharmacy, or medical insurer. We do not provide medical services. We are not responsible for the acts, omissions, or medical judgment of any Provider using the Platform.

5. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

6. Payments, Fees & KRA Compliance

You agree to pay all fees for services you purchase on the Platform. All payments are processed through a secure, third-party payment gateway.

KRA eTIMS Compliance: In accordance with Kenyan tax law, all transactions will be processed and reported through the Kenya Revenue Authority (KRA) eTIMS system. You agree to provide accurate information as necessary for this mandatory invoicing and reporting, and you consent to us sharing transaction data with the KRA for this purpose.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES....

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles.
